Green & Schafle Win $2 Million Settlement for Man Injured in Truck Accident

Green & Schafle attorneys Adam Green and Stephen Specht obtained a $2 million settlement in 2023 for a man that developed chronic spinal problems following a truck accident.

The incident happened in January 2019, when a box truck struck an off-duty police officer causing the officer to fall to the ground after being momentarily pinned between his vehicle and the driver side door. Due to the sudden impact, the officer sustained a spinal cord injury that resulted in cervical spine surgery – and continues to have chronic spinal problems. ## Defendant Contested the Accident Caused Spinal Injuries Initially, the defendant suggested the officers’ spinal injuries were preexisting and that the officer sustained only minor injuries following the incident. Green & Schafle managing partner Adam Green and partner Stephen Specht went to work, gathering evidence and expert testimony to prove that a new spinal injury at the C5-C6 section had occurred and was a direct result of the box truck striking the officer. ## Expert Testimony Introduced to Prove the Extent of the Injuries Although the client had prior neck issues and surgery in 2016, expert testimony from a renowned neurosurgeon was introduced that explained that the officer experienced a new spinal cord injury to the C5-C6 area caused by the 2019 incident, and required a cervical spine operation. The expert arrived at this conclusion by reviewing all relevant MRI’s and EMGs from both prior to the accident and after the accident. Ultimately, this testimony was the information needed to prove that the officer’s cervical spine injury to the C5-C6 level was a direct result of the box truck colliding with the officer.
